Comment:
Section 251.54(e)(2)(ii)(D) of the existing rule
enumerates certain information that might have to be provided by a
private corporation applying for a special use authorization. The
proposed rule redesignated this provision but did not offer any
substantive change.
One respondent commented that the minimum amount of information required from a
private corporation applying for a special use authorization is much greater than what
is required from any other category of applicant and that the only information needed
from private corporations is evidence of incorporation and good standing.
Response
This provision was not subject to substantive amendment under the proposed
rule, is not being amended by the final rule, and has no bearing on the subject matter
of this rule.
Therefore, this provision is beyond the scope of this rulemaking. However,
the Department believes that it may be appropriate to require private corporations
applying for a special use authorization to provide more than evidence of incorporation
and good standing.
